General Motors Defective Speedometers
On November 7, 2008, the U.S. District Court in Seattle granted final approval of a class action settlement for owners and lessees of certain General Motors vehicles with allegedly defective speedometers (also known as "console clusters").
Who is in the class?
Owners or lessees of covered vehicles described below.
What vehicles are covered?
All Year 2003-2005 General Motors GMT800 Platform automobiles manufactured on or before December 31, 2004. These makes and models include:
Chevrolet Avalanche
Chevrolet Silverado
Chevrolet Suburban
Chevrolet Tahoe
GMC Yukon
GMC Yukon XL
GMC Sierra
Cadillac Escalade
Cadillac Escalade ESV
Cadillac Escalade EXT
What are the benefits to which class members are entitled?
The benefit depends on when your vehicle was placed in service and the number of miles on it. Vehicles that were either (1) placed in service seven or more years ago, or (2) have more than 80,000 miles on them, are not eligible for settlement benefits.
Replacement of Console:
If the speedometer or console cluster on your vehicle fails, and it has been less than seven years since the vehicle was placed in service and it has less than 70,000 miles on it, a GM dealer will replace the console at no charge to you. Please note that repairs must be performed by a GM dealer. Repairs performed by non-GM providers are not covered by this part of the settlement.
If the speedometer or console cluster on your vehicle fails less than seven years after the vehicle was placed in service and it has more than 70,000 miles on it but less than 80,000 miles, GM will pay for the cost for the part but will not pay for labor.
Reimbursement for Repairs Before Class Notice:
Notice of the proposed settlement was mailed to potential class members whose identities were known to GM in or around July and August 2008. Owners and lessees of covered vehicles who paid for repairs to the speedometer before receiving that notice are eligible for reimbursement under the following terms:
If the speedometer failed and your vehicle had less than 70,000 miles on it, upon proper proof of claim GM will reimburse you for the cost of repairs (parts and labor) up to the limit of what a GM dealership would have charged.
If the speedometer failed and your vehicle had more than 70,000 miles but less than 80,000 miles on it, upon proper proof of claim GM will reimburse you for the cost of the part only (no labor).
The Claim Form and procedure for filing claims for reimbursement are attached as Exhibit 2 to the Class Notice appended below.
What is the effect of GM's bankruptcy filing on this settlement?
The bankruptcy trustee exempted the settlement from discharge in bankruptcy.
