AutoNation Vacation Pay Lawsuit
COURT OF APPEALS DIV III CONFIRMS ARBITRATOR'S FINAL AWARD OF $2.38 MILLION FOR CLASS. AUTONATION WILL APPEAL.

AutoNation has sought review of the Court of Appeals order with the Washington State Supreme Court. This means that resolution of the case will be delayed for as long as a year or more. Plaintiffs will continue to post updates regarding the status of the case at vacationpaylawsuit.com.
This class action was brought on behalf of more than 500 current and former AutoNation employees in Washington State. The Arbitrator found AutoNation breached its contractual obligations to the employees by failing to give them the paid vacation benefits they had earned between their 2004 and 2005 anniversary dates.
The Final Award includes the following: (1) an award of damages to the Class in the amount of $1,217,954.49, which AutoNation is required to pay; (2) an award of prejudgment interest to the Class in the amount of $231,370 plus $400 per day until judgment is entered, which AutoNation is required to pay; (3) an award of attorneys' fees to Class Counsel in the amount of $884,647, which AutoNation is required to pay; (4) an award of statutory costs to Class Counsel in the amount of $10,246, which AutoNation is required to pay; (5) an award of litigation expenses to Class Counsel in the amount of $112,254, which will be paid from the Common Fund (the combined awards of damages and prejudgment interest); and (6) incentive awards to the named Plaintiffs and Class Representatives in the total amount of $30,000, which will be paid from the Common Fund.
Please note the Arbitrator ruled that only those Class members who were working as of their 2005 anniversary dates are entitled to recover damages. Approximately 500 Class members meet this description, and approximately 60 do not.
