UltraPex Tubing

The King County Superior Court certified Splater, et al. v. Thermal Ease Hydronic Systems, Inc., et al, as a class action in March 2006. The suit alleged that defendants manufactured, advertised, distributed and sold UltraPEX Tubing, a product used primarily in heating and plumbing hot water systems, which prematurely ruptures and fails. All individuals and entities who own or owned homes or other structures in the state of Washington in which UltraPEX Tubing is or has been installed are included in the class.

On July 31, 2009, the court granted final settlement approval. Under the settlement, class members who replaced failed UltraPEX Tubing at their own expense must submit their claims for reimbursement within six months of the Court’s decision. Class members whose UltraPEX tubing has not yet experienced a failure will have to request an inspection or submit a claim for a qualifying future failure within eight years.
