General Motors/OnStar

We are co-counsel in one of the cases that is part of the In Re OnStar Contract Litigation MDL (multi-district litigation) currently pending before the United States District Court for the Eastern District of Michigan. An MDL brings together cases from many jurisdictions for the purpose of conducting consolidated pre-trial proceedings where the matters in dispute are similar. The Second Master Amended Class Action Complaint alleges that OnStar Corporation, a subsidiary of GM, developed and operated a unique in-vehicle telecommunication safety system that provides automatic crash notification to emergency responders as well as remote diagnostics in the event of problems with airbags, anti-lock brakes or other systems. The Complaint also alleges that General Motors (GM), American Honda Motor Company (Honda), Subaru of America (Subaru) and Volkswagen of America (VW) sold and leased vehicles equipped with OnStar's analog telecommunication system while knowing at least as early as August 2002 (but failing to inform their customers) that the equipment would stop working on February 18, 2008, when a switch to digital signals would take place. Discovery is on-going and the case has not yet been certified as a class action.
