Wal-Mart Wage and Hour Class Action
On October 1, 2004, King County Superior Court Judge Terry Lukens certified a Washington State class action case against Wal-Mart Stores, Inc. for violations of Washington's wage and hour laws and Consumer Protection Act. Wal-Mart has approximately 49 stores in Washington State, and the class is estimated to include over 75,000 current and former employees.
Wal-Mart appealed the Court's decision, but on July 3, 2006, the Court of Appeals affirmed Judge Lukens' order.
Wal-Mart requested review of the Court of Appeals decision by the Washington State Supreme Court. On May 1, 2007, the State Supreme Court denied Wal-Mart's request, thus sending the case back to the trial court to set a trial date.
On August 7, 2007 the case was reassigned to the Honorable Julie Spector.
Notice of class action status was mailed to over 75,000 current and former Wal-Mart employees on November 29, 2007.
The parties reached a settlement in late 2008 and have requested preliminary approval of the settlement by Judge Spector.
On May 13, 2009, the King County Superior Court granted preliminary approval to the parties' settlement of the case. Notice of the settlement and claim forms have been mailed to more than 80,000 class members.
The court granted final approval to the settlement on July 20, 2009. Class members have until August 19, 2009 to submit a claim form to the claims administrator. To request a notice packet, please contact the claims administrator at 1-877-867-6208.
